  • Where to seek help?

    If the employer refuses to pay the salary of an Executive whom has resigned. which legal resources he is able to seek help? (under MOM, Executive is not covered by the union)

    Or the poor chap has to suffer in silence?

    Anyone has the experience in such situation or the best legal way to go about it?

    My suggestion is to file a police report and go MOM. All employee can seek assistance from MOM as long as employer refuse to pay the salary according to the employment act.

        dont think MOM will handle handle disputes bwt "C" grades staff and employer. and if company fires ceo, board already hav very good justifications and action plans after seeking legal opinions. best option is to seek legal opinion, or to settle out of court and go silently in order not to jeopardise his future employment opportunities.

          i suggest to approach MOM. they do protect executive and junior manager under 4.5k. your friend is filing a case based on unpaid wages not job representation. union can help ur friend as PMET too. not really in terms of job representation but unfair dismissal.

          but 1st, did your friend resigned with advance notice listed in his/her contract? if not, this outstanding salary can be considered as compensation for termination of contract. please check with him/her.

          let's say, he/she quit with adv notice or being terminated by company, the company must pay the outstanding amount regardless of what.

          if not go under common law.
